A 40-year-old Carroll man was arrested twice in one night for operating a vehicle while intoxicated, according to court records. He was cited and released after the first arrest because the county jail was full.
Kenneth Kayce Harris was stopped by a police officer a total of three times starting about 9 p.m. Tuesday, when he was cited for driving with a revoked license and for not having insurance.
An officer saw him driving again about 11:15 p.m. in the 1100 block of Plaza Drive and stopped Harris, who had small, unopened containers of vodka in the vehicle. Harris allegedly admitted he had been drinking alcohol and failed tests of his sobriety, but he did not comply with a test of his breath to determine his blood-alcohol concentration.
Harris was charged with first-offense operating while intoxicated and cited again for driving with a revoked license and for not having insurance.
"He was cited and released due to the full capacity at the jail," an officer wrote in a criminal complaint.
Then today at 2 a.m. the same officer saw Harris driving again. Harris parked at Fairview Village Apartments in the 500 block of East 18th Street, where "it was apparent at this time that he was more intoxicated than my previous encounter with him," the officer wrote.
Harris allegedly had two open containers of alcohol in the vehicle. He declined the breath test again and was charged with operating while intoxicated, driving with a revoked license and for not having insurance. He was also cited for having an open container of alcohol in a vehicle.
